Sunny Sailing (UK) Booking Conditions

These terms and conditions apply to booking made with Sunny Sailing (UK):

Definition

Yacht Charter Company: Sunny Sailing.
Charterer: The person booking the yacht charter with Sunny Sailing.

Communication

Communication between the Charterer and Sunny Sailing and vice versa will primarily by email or telephone.

Option/Reservation

Taking a reservation/option on a charter yacht will take place by sending Sunny Sailing an email or by making a reservation by phone. To secure the reservation/option a Booking Form must be submitted. Once the Booking Form has been received, Sunny Sailing will send a proforma invoice with details of the methods of payment available, your booking will not be secured until the pament requested has been recieved. If you do not pay according to the terms of payment we will invoice you the cancellation costs as detailed below.

Terms of Payment

Deposit to secure a booking 30% of the yacht price and balance 8 weeks before departure to Greece.
If you book within 8 weeks for departure to Greece payment of the whole invoice amount required. If you book a yacht with Sunny Sailing  only 2 weeks before departure to Greece we will ask you to make a Card payment, pay Cash or an immediately Bank transfer.

Cancellation of the Sailing Holiday

If you cancel your holiday in the period 6 weeks before departure to Greece, the deposit of 30% will not be refunded.
If you cancel your holiday in the period within the 6 weeks before departure to Greece, the total invoiced amount is due to Sunny Sailing.

Changing the Booking Conditions

If you want to change your booking after making the booking definitive by sending us the booking form, we will invoice you £12.50/ € 15,00 - administration costs.

Sailing Holiday Period

The holiday period is measured by whole days. for an extreme example if you  leave at  23.00 hrs and return to your start destination at 08.00 hrs with 6 days to spend away from the marina then Sunny Sailing will still consider this as an 8 days holiday.

The latest check in time for your yacht should be 17.00 hrs on the start day and you are required to leave your yacht at 08.30 hrs on the last day. (Start days are normally Saturdays or Sundays)
This is necessary to allow Sunny Sailing time for cleaning and technical repairs which have to be carried out before the charterer can check in on the yacht. Boat papers will be arranged after your arrival at the marina when checking in at our office.

Booking (Party Leader/Skipper)

The person who made the booking is personally responsible for all other members of the crew listed on the Booking Form for the specific booking on the yacht.

If children under 16 years in the party have been booked on the holiday, it is a booking condition of Sunny Sailing that the parents or responsible adults for these children have given their permission.
Only the agreed number of people detailed on the booking form, will be allowed on the yacht if it is necessary for the holiday to be cancelled or incur extra costs. The right to claim your money back will not be possible.

The charterer is totally responsible for the rented yacht after check in. The skipper of the chartered yacht must have sufficient (technical) experience/skills to take care of the safety of all crew members.
The charterer has to give all crew members the right information about all the possible dangers aboard, such as handling the electric anchor winch, turning engine, changing gas bottles, etc. Sunny Sailing cannot be held responsible for injuries, due to failure of equipment during the charter.

Maritime Skills

To charter a yacht the skipper must have enough skills to cruise/sail the yacht. If Sunny Sailing management decide that the skipper does not have such skills, Sunny Sailing reserve the right to put a skipper on the yacht for the period of the charter, at the charterers expense. Should the charterer not wish to pay for a skipper then the yacht will not be allowed to leave the marina, but the charterer may remain on board for the period of the charter. No refunds will be given to charterers found not to have enough skills to sail alone.

Travel documents / Health conditions

Travellers to Greece from counties within the EU will require a passport and from other countries they should check should different rules apply before travelling. Vaccinations are not required. To charter a yacht in Greece you will need a valid passport or ID card.
You can get more information about health rules at your own doctor or regional health centre.
All this is based on the knowledge of the 14th July 2003 and as such written down in the chamber of commerce.

Personal Information

For a good carrying out of the holiday the charterer has to give the necessary information of the whole crew. This article is not only concerning the mental or physical handicaps but also other forms which are important for having a sailing holiday.

The Yacht Security Deposit

The security deposit has to be paid to Sunny Sailing during administrative in check.
You can pay the deposit cash or by Card. If there is damage/loss, Sunny Sailing will deduct the cost of this from the security deposit. The security deposit is the limit of the own risk, if the damage/loss is higher than the amount of the own risk the insurance of Sunny Sailing will cover the rest.
The offered yachts are all risk insured by Sunny Sailing. The deposit will be returned to the charterer after being checked out of the yacht, possible reduced with the damage of the yacht/inventory.
The yacht dinghy is not covered by the security deposit therefore the charterer is liable for the
replacement cost should it be lost.
After arrival in Greece the charterer has to pay obliged on site charges and the ordered options, such as harbour due, fuel and the extra’s as ordered by you as an outboard, sheets, etc.

Complaints

Control of the yacht before departure by the charterer is an important issue.
If the charterer states there are serious insufficiencies on the yacht, or troubles occur during the sailing holiday, the charterer has to contact Sunny Sailing immediately. Sunny Sailing will take actions to solve the problem.

Inventory

The yacht will be delivered to the charterer safe, clean and with the total inventory. The inventory list is aboard. At the end of the charter period the charterer will deliver the yacht with the complete inventory and in the same state/condition back to Sunny Sailing as he received it.

Small repairs

The charterer is expected they can do small repairs by them selves, to avoid problems or damages.

Repairs

The charterer has to be aware when he is out of Lefkas Marina, repairs and delivery of spare parts can take time. If there is a serious failure to the chartered yacht, by any reason, the charterer does not have the right to complain formally if the specific failure is solved within 36 hours.

Flotilla Service

The charterer stays always responsible for the chartered yacht. The flotilla leaders always only give advice. The flotilla leaders can never be taken responsible for damages following out of the given advice to the charterer.

Expectations of the Holiday

Having a good holiday is partly dependent of the weather circumstances. Unfortunately nobody can predict the weather. If there are more days you can not sail or go out because of the weather or you have to make expenses it is the risk of the charterer. 

A holiday abroad means other people with other habits, culture and different food than at home. This is one of the nice things about holidays abroad, but it is  also an aspect the charterer has to be prepared for, from differing  shop and bar opening times and reduced facilities in the low seasons.

We do not advise you drink tap water in the area where you will be sailing. On the yacht there is a limited supply of water. During your sailing holiday there will be opportunity to take on more water but not everywhere. So we advise you to be economical with your water supply and to remember the needs of other yachts when taking on fresh supplies.

Reponsability

Sunny Sailing will not be held responsible for damage, injuries, loss, robbery/stealing which can occur during your sailing holiday as arranged by Sunny Sailing.

Cancelation by Sunny Sailing

In the unlikely event of Sunny Sailing being unable to make the chartered yacht available, and Sunny Sailing is totally not in the position to have influence on that, Sunny Sailing will keep the right to offer an alternative yacht to one of comparable size and value, if not  a refund or charge will be made to the charterer. If the charterer can not agree with the alternative yacht the charterer has the right to cancel the holiday without costs. This has to be confirmed by the charterer within 24 hours after notification by Sunny Sailing that a change of yacht is necessary. Sunny Sailing cannot be held responsible for any costs following any such cancelation.
 

Complaints Procedure

Sunny Sailing aim to provide you with the best possible holiday and one that meets your expectations. However if a problem occurs you must report this immediately (or as soon as it is possible) to the yacht base manager or Hotel/Accommodation owner who will try to resolve this on the spot. However if you are not satisfied, you should make them aware of your dissatisfaction and write to us as soon as possible, but not later than 14 days after your holiday.

Sunny Sailing (UK) do not supply any of the services paid for outside the UK. The options, extras and other services provided for your charter in Greece or Turkey must be paid for at the yacht base. Complaints regarding these services including the flotilla service and skippers must be reported on site, as they can only be resolved or refunded where the purchase was made.
